Overview of  the Philippine Telecommunications

& ICT Industry

Telecommunications is classified as a public utility. Under the Philippine Constitution, foreign ownership of a public utility business is only limited up the maximum of forty percent (40%). The National Telecommunications Commission (NTC) is the Philippine government agency which regulates the operation of telecommunications business. At present, there are ten (10) registered Telecommunications players in the Philippines such as Bayan Telecommunications Inc., Digital Telecommunications Philippines, Inc., Eastern Telecommunications Philippines, Inc., Express Telecommunications Co, Inc., Globe Telecom, Inc., Philippines Global Communications, Inc, Pilipino Telephone Co., Philippine Long Distance Telephone Co., Philippine Telegraph And Telephone Corp., and Smart Communications, Inc. Among the ten, Philippine Long Distance Telephone Co. is regarded as the most dominant.

Value Added Service (VAS) - As per broad definition under the Public Telecommunications Policy Act of the Philippines (RA 7925), VAS is an entity which relying on the transmission, switching and local distribution facilities of the local exchange and  inter-exchange operators, and overseas carriers, offers enhanced services beyond those ordinarily provided for by such carriers. Non-Public Telecommunications Entity (PTE) offering VAS does not need a franchise to operate but they are required to register with the NTC for proper monitoring, provided further they will not setup their own network infrastructure. VAS providers should also be at least 60% Filipino owned pursuant to the new NTC Guidelines for registration of VAS providers.

Voice Over Internet Protocol (Voip) - Voip business is now classified by the NTC as a Value Added Service. However, since Voip falls under the broad definition of Telecommunications, foreign ownership of a Voip Service Provider business is limited up to the maximum of 40%. It is also required that Voip Resellers should be at least 60% Filipino owned pursuant to NTC Memorandum Circular No. 3-11-2005.

Information & Communications Technology (ICT) - Services that are in-line with ICT also fall within the investment priorities plan of the government. ICT Services and activities include all types of software development, all Outsourcing services that are channeled through ICT Infrastructure, all ICT activities research and incubation. 100% Foreign ownership of an ICT services and activities is also allowed.
